This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "You") and Breles LLC ("Company", "We", "Us") regarding your use of the Cross Stitch Pattern Maker Pro mobile application (the "App").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acknowledgment

This Agreement is concluded between you and the Company only, and not with Apple Inc. ("Apple"). The Company, not Apple, is solely responsible for the App and the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

2. License Grant

The Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

3. Subscription and Payments

A. Subscription Plans

Cross Stitch Pattern Maker Pro offers auto-renewing subscription options (Monthly and Yearly) and a one-time purchase option (Lifetime) to access premium features such as unlimited PDF exports, AI Wizard, and advanced editing tools.

B. Payment & Renewal

  • Payment will be charged to your Apple ID account at the confirmation of purchase.
  • Auto-Renewal: Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
  • Account Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase.

C. Free Trials

We may offer a free trial period. If you do not cancel before the trial ends, you will be automatically charged the subscription fee. Any unused portion of a free trial will be forfeited when you purchase a subscription.

4. User-Generated Content

A. Ownership

You retain all ownership rights to the patterns, images, and designs you create using the App ("User Content"). We do not claim ownership over your designs.

B. License to App

By creating content, you grant the Company a license to process and store your content locally on your device or on our secure servers solely for the purpose of providing the App's functionality (e.g., generating PDFs).

C. Responsibility

You are solely responsible for the content you import into the App. You agree not to use the App to process content that violates the intellectual property rights of others.

5. Intellectual Property Rights

The App, including its source code, design, "AlphaText" feature, AI algorithms, and trademarks, is owned by Breles LLC and is protected by international copyright and trademark laws.

6. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that the thread color matching (DMC/Anchor) will be 100% accurate to real-world threads due to screen calibration differences.

7. Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App, including but not limited to loss of data or profit.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.
